Residential properties such as STUDIO PLAZA APARTMENTS are not, and cannot be, constructed to exclude mold. Moisture is one of the most significant factors contributing to mold growth. The relatively close proximity of STUDIO PLAZA APARTMENTS to the beach and the Pacific Ocean is an environment with a relatively higher moisture level and consequent ambient levels of mold, both indoors and outdoors. This is a special material factor for your consideration in leasing an apartment. Information about controlling mold growth is available from the California Department of Health Services, and the U.S. EPA*. Certain species of mold may cause damage to property and may adversely affect the health of susceptible persons, including (but not limited to) allergic reactions that may include skin, eye, nose, and throat irritation. Certain species of mold may cause infections, particularly in individuals with suppressed immune systems. Some experts contend that certain species of mold may cause serious and even life-threatening diseases. However, experts do not agree about the nature and extent of the health problems caused by mold or about the level of mold exposure that may cause health problems. The Centers for Disease Control and Prevention is studying the link between mold and serious health conditions. STUDIO PLAZA APARTMENTS cannot and does not represent or warrant the absence of mold. If you believe that you, or any other person who will reside in the apartment, have any sensitivity to mold, due to allergies, asthma or for any other reason, then it is your obligation as a prospective tenant to determine whether a mold problem is present. To do so, you should hire a qualified inspector and make any contract to lease an apartment contingent upon the results of that inspection. STUDIO PLAZA APARTMENTS shall not be liable to you or any other person in any action based on the presence of or propensity for mold within or at the premises. The STUDIO PLAZA APARTMENTS "Rental Agreement", and the "Mold Disclosure, Release of Liability, and Agreement Not to Sue Addendum" specifies that the TENANT is contractually responsible for maintenance and remedial action for any water intrusion and/or mold within the TENANT'S apartment unit. I authorize you to verify the information provided in this application from my credit sources, credit bureaus, current and previous landlords and employers, and personal references. If my application is accepted and I rent an apartment at Studio Plaza, I agree to conduct myself as a quiet, responsible adult; abide by all provisions of the rental agreement; and abide by all Building Rules and Addendums. It is your responsibility to contact Studio Plaza to determine whether your application has been accepted. If your application is accepted, you may choose an apartment and place your $300 security deposit by cashier's check, money order, or traveler's check. First and last months' rent in the form of cashier's check, money order, or traveler's checks are due on the date your contract begins. Studio Plaza Apartments and Applicant agree that if Applicant changes his/her mind and fails to sign the Rental Agreement and pay the first and last month's rent, Studio Plaza Apartments will retain from the $300 deposit the sum of $50.00 to compensate Studio Plaza Apartments for any costs incurred and the inconvenience of holding the apartment vacant.
